Judgment
This application is filed by the appellant-original accused who has challenged the judgment of conviction and sentence passed by the trial Court. He has been convicted for offences punishable under Sections 337, 338 and 304 Part-II of IPC. Different sentences have been awarded, highest of it being 3 years of rigorous imprisonment. He requests that the sentence be suspended and he may be continued on bail. Pending trial he was on bail. I am informed that after the judgment of conviction he has not surrendered.
The impugned judgment was passed on 11th December, 2018. So far, no order of bail pending appeal has been passed in his favour. Ordinarily, therefore, he ought to have surrendered.
However, this appears to be an oversight on part of all concerned.
In the interest of justice, therefore, following order is passed.
The applicant shall surrender before the concerned trial Court latest by 16th January, 2020. Thereupon, he shall be released on bail upon furnishing bond of Rs.10,000/- with two sureties of like amount on the condition that as and when required by the High Court in the present appeal(Crl. A. No.2/2019), he shall make himself available.
With these directions the application is disposed of.
