Judgment

Heard Mr. J. Bhattacharjee, Learned counsel assisted by Mr. Sajib Ghosh, Learned counsel appearing on behalf of the applicant.
The appellant has preferred an appeal under Section 374(2) of Cr.P.C. challenging the judgment and order of conviction and sentence dated 13.12.2024 delivered by Learned Additional Sessions Judge, South Tripura, Belonia in connection with Case No.S.T.18(Type-1) of 2023. By the said judgment, Learned Trial Court has found the appellant to be guilty and sentenced him to suffer RI for three years and pay a fine of Rs.1,00,000/-, id to suffer further SI for two months under Section 494 of IPC and also the Learned Trial Court found the appellant to be guilty of offence punishable under Section 417 of IPC and sentenced him to suffer RI for one year and pay a fine of Rs.1,00,000/-, id to suffer SI for two months with further direction that the sentences shall run concurrently. Along with the petition another application under Section 389 of Cr.P.C. is filed for suspending the judgment and order of conviction and sentences dated 13.12.2024 delivered by Learned Additional Sessions Judge, South Tripura, Belonia in connection with Case No.S.T.18(Type-1) of 2023.

Considering the nature and gravity of the offence, the order of conviction and sentence dated 13.12.2024 delivered by Learned Additional Sessions Judge, South Tripura, Belonia in connection with Case No.S.T.18(Type-1) of 2023 be suspended till disposal of this appeal subject to execution of bail bond of Rs.1,00,000/- with one surety of like amount by the appellant to the satisfaction of Learned Additional Sessions Judge, South Tripura, Belonia. The appellant convict may execute the bail bond accordingly to the concerned Learned Court.
