Judgment

By this application, the applicant has prayed for suspending the judgment and order of sentence dated 18.02.2022 passed by the Special Judge, Gomati Judicial District, Udaipur, in case No. Special (POCSO) 06 of 2020 convicting the applicant to suffer S.I. for 3 (three) years and to pay a fine of Rs. 5,000/-, till final disposal of the connected criminal appeal.
Heard Mr. TD Majumder, learned senior counsel assisted by Mr. T. Halam, learned counsel appearing for the applicant. Also heard Mr. Ratan Datta, learned PP appearing for the respondent-State.
Mr. Majumder, learned counsel has submitted that the applicant is on bail and he has never misused the privilege of bail during trial, before the trial court.
Since the appeal has been admitted to be heard and the record has been called for, I am inclined to suspend the order of sentence dated 18.02.2022 passed by the Special Judge, Gomati Judicial District, Udaipur, in case No. Special (POCSO) 06 of 2020, till disposal of the instant appeal.
Accordingly, the applicant is allowed to go on bail on furnishing a bail bond of Rs. 25,000/-, supported by one surety of the like amount to the satisfaction of the learned Special Judge (POCSO), Gomati Judicial District, Udaipur.
The interlocutory application for suspending the sentence, as stated above, is accordingly disposed of.
