The applicant is stated to have been enrolled under the respondents as Constable in the year 1980 and was promoted to the post of Head Constable.
Learned counsel for applicant submits that the applicant is aggrieved of the order dated 18.12.2019 (Annexure A-1) vide which he was pre-maturely
retired by the respondents. Aggrieved of the aforesaid pre matured retirement, the applicant is stated to have made a representation dated 31.12.2019
(Annexure A-2). Learned counsel for the applicant submits that the present application under 19 of Administrative Tribunal Act, 1985 has been filed
by the applicant for directions to the respondents to consider and reply on the aforesaid representation.
Heard. Issue notice. Shri Saksham Ahuja, proxy counsel for Ms Esha Mazumdar, learned counsel, who appears on advance service for
respondents, accepts notice. He submits that the copy of the aforesaid OA has not been supplied to him. Learned counsel for applicant undertakes to
supply another copy of the OA to the learned standing counsel for respondents positively within a week from today.
In view of the facts and circumstances, the present OA is disposed of with direction to the respondents to consider the applicant’s aforesaid
representation (Annexure A-2) and to dispose of the same by passing a reasoned and speaking order and serving a copy thereof on the applicant as
expeditiously as possible and in any case within 8 weeks of receipt of a copy of this order.
The OA is disposed of with the aforesaid directions. No costs. It is made clear while passing the present order we have not commented upon the
merits of the claim of the applicant.
