Judgment
Head the Ld Counsel appearing for the applicant IRP and the Ld Counsel appearing for the financial creditor. It is submitted that the order dated 30.03.2026 is complied by the respondent FC by paying the penalty and the meeting has been conducted with 'the liquidator. The matter under CP IB308 of 2020 was appealed before the Hon'ble NCLAT which has vide its order dated 27.08.2025 reverted back the matter directing appointment of the liquidator. The matter before this tribunal was on the payment to be made to the liquidation during the liquidation process as the only financial creditor( who had a joint venture agreement with the respondent CD) and the matter was admitted on 5.8.2022 and the amicus curiae it was suggested to appoint a liquidator.
In view of the compliance to the order, and since the IRP has been continuing as IRP since the initiation of CIRP, for the purpose of continuity and since the matter relating to the fees has now been settled between the parties, we allow the application and appoint Ms. Poonam Basak having Reg No. IBBI/IPA-oo1/IP-P01234/2018-2019/11957 as liquidator of the CD. She is directed to complete the process of liquidation within a period of 6 months,
Both the IAs are disposed of with these directions.
