Alok Singh, J.—Mr. Indrajit Sinha, learned counsel appearing for the petitioner contends that management of SAIL, R and D Centre has never terminated services of the Afroz Ahmed, Mahabir Gope, James Bhengra, Sahdeo Mahil and M. Prakash Jojo and their services were terminated by the contractor. He further contends that even contract of the contractor has already been terminated by the SAIL, therefore, petitioner is not the proper party in industrial dispute referred by the Central Government vide impugned order dated 18.4.2012. His further contention is reference was made in a language as if SAIL has terminated services of the contract labourers engaged by the contractor. In the opinion of this Court, if Labour Court comes to the conclusion that services of the contract labourers viz., Afroz Ahmed and others were not terminated by the petitioner, no award may be passed against the petitioner. Therefore, petitioner may take all the pleas before the Labour Court.

In view of the above, I am not inclined to entertain this petition at this stage. Accordingly, this writ petition is dismissed.
