The present bail cancellation application has been filed against the order dated 27.10.2021 passed in S.B. Criminal Misc. 2nd Bail Application No.14078/2021, whereby, the respondent-Harish Prajapat was enlarged on bail by this Court.
Heard.
Respondent- Harish Prajapat was extended the benefit of enlargement of bail on the ground that co-accused Bheru Singh was enlarged on bail by the trial Court vide order dated 01.10.2021 and, thereafter co-accused Faruq and Arpit were also enlarged on bail by this Court and the case of respondent- Harish Prajapat was not found to be distinguishable from the co-accused who were already enlarged on bail.
Learned Public Prosecutor is unable to point out any specific instance of the respondent having misused the liberty after enlargement on bail. He is also not in a position to specifically point out repetition of any similar incident by the respondent on which he was enlarged on bail.
Considering the averments made in the application for cancellation of bail and the submissions made before this Court, this Court is not convinced to allow the bail cancellation application preferred by the State and the same is, therefore, dismissed.
