The present bail cancellation application has been filed by the petitioner-complainant for seeking cancellation of bail granted to the accused-respondents No.2 to 4 by this Court vide orders dated 15.02.2022 & 02.02.2022.

Counsel for the petitioner-complainant submits that after enlarging on bail, the accused-respondents No.2 to 4 started threatening the petitioner-complainant and therefore, they misused the liberty of bail. A complaint was filed by the petitioner-complainant in this regard against the accused-respondents No.2 to 4 before the concerned Police Station, but no action was taken against them. Therefore, it is prayed that the bail granted to the accused-respondents No.2 to 4 by this Court may be cancelled.

Learned Public Prosecutor and learned counsel for respondents No.2 to 4 have vehemently opposed the prayer made by the counsel for the petitioner-complainant and submitted that a false complaint has been filed by the petitioner-complainant against the accused-respondents No.2 to 4 whereas, they are living peacefully in the society and they never misused the liberty of bail granted by this Court. The trial of the case is going on smoothly. Therefore, the bail cancellation application may be rejected

Heard learned counsel for the parties and perused the material available on record.

The bail was granted to the accused-respondents No.2 to 4 way back on 15.02.2022 and 02.02.2022 and two years have already been passed. The trial is going on smoothly. In such circumstances, no case is made out to cancel the bail granted to the accused-respondents No.2 to 4.

Hence, the bail cancellation application is hereby rejected.
