Judgment

Heard Mr. S. Deb, learned counsel who has submitted that he has been instructed by the respondent to appear in this matter, however, the power could not be filed right now and it will be filed in course of the day. He also submits that a copy of the petition may be supplied to him.
Mr. K. Khan, learned PP for the petitioner/State of Meghalaya has submitted that this matter may be taken up for hearing on the next date.
It is also the submission of the learned counsels for the parties that the Court of the learned Judge, District Council Court, Shillong is seisin of the matter, inasmuch as, an application under Section 438 Cr.P.C for grant of pre-arrest bail is pending before the said Court. Accordingly, it is made clear that since there is no interim order in this regard, any order or observation passed in this matter should not influence the said Court of the learned Judge, District Council Court, Shillong to decide on the matter in accordance with law.
