Judgment

Heard Mr. S.M. Suna, learned counsel, who has submitted that this is an application under Section 438 Cr.P.C with a prayer for grant of pre-arrest bail on behalf of the petitioner, who is said to be wanted in connection with Jowai P.S. Case No. 25 (05) of 2024 under Section 307 IPC.
This Court, has taken into consideration the submission made by the learned counsel and also the objection raised by Mr. N.D. Chullai, learned AAG, however, to satisfy this Court to the factual aspect of the matter, since there are two parts as far as the cause of the injuries sustained by the alleged victim is concerned, the case diary is required to be produced. Accordingly, the Investigating Officer is directed to cause production of the case diary of Jowai P.S. Case No. 25 (05) of 2024 on the next date fixed.
As prayed for, list this matter on 11.06.2024.
In the meantime, the petitioner is allowed to go on interim bail on condition that he shall not abscond or tamper with the witnesses or evidence and that he shall appear before the Investigating Officer as and when required.
Order passed accordingly.
