State of H.P and Others vs Inder Singh and Others

Kurian Joseph, C.J.—State has come up in appeal against the judgment dated 8.3.2010, passed in Inder Singh and Ors. v. State of H.P and Ors. CWP No. 2709 of 2008. It is seen that the writ petition is disposed of giving the benefit of the judgment rendered in Mool Raj Upadhyaya Vs. State of H.P. and Others, to the Petitioners except Petitioners No. 2 and 4, in whose case, learned Counsel for the Petitioner submitted that now there case will be covered by Rakesh Kumar v. State of H.P. The learned Deputy Advocate General submits that the whole factual aspect of the matter will be verified and benefit thereof will be granted after the verification of various aspects. Therefore, the LPA is disposed of making it clear that the while implementing the judgment as far as the writ petition No. 2709 of 2008 is concerned, their case will be considered in the light of Mool Raj Upadhyaya''s case and as far as the case of Petitioners No. 2 and 4 is concerned, their case will be considered in the light of decision rendered in Rakesh Kumar v. State of H.P. Needless to say, that subject to the Petitioners'' satisfying the requirement under law in terms of the judgment, needful be done within a period of four months from the date of production of copy of this judgment before the authority concerned.

The LPA is disposed of in the above terms, so also the pending application(s), if any.
