This Appeal, under Section 100 of the Code of Civil Procedure, is filed by the Appellants/Respondents/Defendants, challenging the Decree and Judgment, dated 26.09.2007 in A.S.No.4 of 2007 passed by the learned Senior Civil Judge, Sompeta.

When the matter is listed today under the caption for ‘dismissal’, none appeared for the appellants.

The learned counsel for the respondent represented that by serving notice to the learned Government Pleader for Arbitration in the year 2015 itself, they filed a memo before the Registry, composite High Court of Andhra Pradesh, on 23.06.2015 by stating that the sole respondent herein died on 08.03.2015 leaving behind his wife Chandramma, aged 70 years and son Doogana Anantharao, aged 46 years, both are residing at the same village in Palasa Mandal. Despite of receiving the particulars of the legal representatives of the sole respondent to be added on record, the appellant has not shown any interest to add the legal representatives of the sole respondent. Therefore, the appeal against the respondent is abated.

In the result, the second appeal against respondent is dismissed as abated.

As a sequel, miscellaneous petitions, if any, pending in the appeal shall stand closed.
