O R D E R
This Application has been filed by the RP for leave to proceed against the personal guarantor in terms of Section 121 IB Code on the ground that despite sufficient opportunity, the personal guarantor has not come forward with any repayment plan. It is further submitted by the RP as per the minutes of CoC, the personal guarantor had even stated that he has no objection for initiation of proceedings under Section 121 of IB Code. Perused the records, since there is no repayment plan submitted by the RP despite opportunity, we allow the prayer of the Petitioner and grant leave to initiate proceedings in terms of Section 121 of IB Code, in accordance with the provisions of law. With these directions IA (IBC) 1763/2023 is allowed and disposed of.
