Heard the learned counsel for the appellant. Proxy counsel appears on behalf of the respondent with authority letter of the main counsel.

This is a matter in which the appellant has challenged the State’s Commission’s order passed against it by placing him ex parte. The Hon’ble Supreme Court vide its order dated 04.12.2019 in Civil Appeal no.9317 of 2019 has remanded the matter to this Commission, leaving open to the appellant to file an application before the National Commission.

Counsel for the respondent has no objection if the matter is remanded to the State Commission for adjudication, subject to cost. It is submitted by the learned counsel for the appellant that cost of Rs.10,000/- as ordered by the Hon’ble High Court of Judicature at Bombay Bench at Aurangabad vide order dated 03.05.2018 in WP no.2104 of 2017 has already stands paid. In case, if the amount of Rs.10,000/- has not been paid, the same shall be paid within fifteen days to the respondent.

The appeal is remanded to the State Commission, with the direction to adjudicate the matter after due notice and opportunity to the parties preferably within a period of four weeks.

Parties are directed to appear before the State Commission on 5th March 2024.
