Judgment
THE matter was passed over.
ON the second call also, there is no appearance on behalf of the respondents.
IT transpires from the record that respondent no.1/complainant has sent his written arguments. Heard and perused record as well as written arguments submitted by respondent no.1
VIDE impugned order dated 15.12.2014 passed by State Commission, appeal filed by the petitioners before the State Commission was dismissed observing that they are not interested to proceed with the appeal but they are interested only in keeping the matter pending.
LEARNED counsel for petitioners submits that the impugned order be set aside the matter be remanded back to the State Commission for deciding the appeal fresh on merit.
KEEPING in view the facts and circumstances of the case and in order to have decision on merits, present revision petition is allowed and impugned order passed by State Commission is set aside. The matter is remanded back to the State Commission to decide the appeal fresh, after hearing both parties, subject to payment of cost of Rs.10,000/ - (Rupees Ten Thousand only).
COST be remitted by the petitioners directly to the respondent no.1 by way of demand draft within four weeks.
THE State Commission shall make an endeavour to dispose of the appeal preferably within a period of six months, from the date of receipt of this order.
IN case, petitioner fails to comply with the above directions within the specified period then the present revision petition shall stand dismissed automatically, without any further order.
PARTIES to appear before the State Commission on 10.07.2015.
