ORDER

Ms. Mily Ghoshal, Ld. Counsel for the Financial Creditor present. None present on behalf of the Corporate Debtor.

Ld. Counsel for the Financial Creditor states that the date of default is 30.03.2020 in terms of extension for repayment of debt granted to the Corporate Debtor. This date fells under Section 10A. Alternatively, Ld. Counsel for the Financial Creditor pleaded that the original date of default was in the year 2017, if this date take into consideration that is barred by limitation.

Ld. Counsel for the Financial Creditor seeks some time to explain her position on maintainability.

Later on, the Ld. Counsel for the Financial Creditor reported that she is intended to withdraw the Company Petition with liberty to proceed as per law.

Accordingly, on the request made by the Petitioner for withdrawal of Company Petition, C.P. (IB)/191(MB)2023 is dismissed as withdrawn with liberty to proceed as per law.
