Father of the petitioner had obtained a license for running a saw mill since 1995 in the property in Rs.No.84/8 of Vazhakkad Village, Malappuram District. Apparently, issue with respect to the license arose consequent to the introduction of the Kerala Forest (Regulation of Sawmills and Other Wood-based Industrial Units) Rules, 2012. Anyhow, the grievance of the petitioner is that consequent to the death of the father of the petitioner, even though petitioner approached the Forest authorities seeking to issue No Objection Certificate in favour of the petitioner, it is not considered by the competent authority. Therefore, petitioner seeks for consideration of Ext.P10 request made by the petitioner for issuing No Objection Certificate.
Learned Special Government Pleader (Forests) on instructions submitted that the application submitted by the petitioner would be considered, taking into account, all attendant documents, and if they are in order, No Objection Certificate will be issued.
In that view of the matter, after having heard the learned Counsel for the petitioner Sri. Martin Jose and the learned Special Government Pleader (Forests) Sri. T.P.Sajan, the writ petition is disposed of, directing the Divisional Forest Officer, Nilambur – the 2nd respondent – to finalize Ext.P10 application, at the earliest, and at any rate, within a month from the date of receipt of a copy of this judgment, after providing an opportunity of hearing to the petitioner.
The writ petition is disposed of accordingly.
