Judgment
The present application has been filed for grant of regular bail to the petitioner in connection with Dumri P.S. Case No.136 of 2019, corresponding to
G.R. Case No.188 of 2020, registered under Sections 467/ 468/471/ 472/ 273/ 290/ 420/ 120(B)/473 and 272 of the Indian Penal Code and Section
47(a)/55 of the Excise Act.
Learned counsel for the petitioner has submitted that the petitioner is in judicial custody since 17.03.2020. It has been further submitted that the
petitioner has been falsely implicated in the present case. Although he is named in the F.I.R. but similarly situated accused person, namely, Chetan
Tuddu @ Chaitan Tuddu and Anil Tudu have been granted bail by the Co-ordinate Bench of this Court vide order dated 26.05.2020 passed in B.A.
No.2750 of 2020 and Pitamber Kumar Singh @ Pitamber Singh has been granted bail vide order dated 29.05.2020 passed in B.A. No.2699 of 2020.
Hence he deserves to be enlarged on bail.
Learned A.P.P. has opposed the prayer for bail of the petitioner. Considering the material available on record and the fact that the similarly situated
persons have already been granted bail, the petitioner, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten
thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Giridih in connection with Dumri
P.S. Case No.136 of 2019, corresponding to G.R. Case No.188 of 2020, subject to the conditions that the petitioner will submit self attested copy of
his Aadhar Card and also give his mobile number before the learned court below which he will not change during pendency of this case without prior
permission of the court.
