Judgment
Accused no.2 in Crime No.184/2026 registered by Attibele Police Station, Bangalore District for the offences punishable under Sections 137(2), 140(2) read with 3(5) of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail.
Heard the learned Counsel for the parties.
FIR in Crime No.184/2026 was registered by Attibele Police Station, Bangalore District for the aforesaid offences against Raghu and others based on the first information dated 11.06.2026 received from Rashmi Sonad. During the course of investigation of the said case, the petitioner was arrested on 12.06.2026 and was arrayed as accused no.2 and remanded to judicial custody.
The bail application filed by the petitioner before the jurisdictional Sessions Court in Crl.Misc.No.5336/2026 was dismissed on 16.07.2026. Therefore, the petitioner is before this Court.
In the first information which is submitted on 11.06.2026, it is stated that the first informant is a social worker who was working for the last 10 years in an NGO known as Aashraya Foundation. The victims in the present case were in acquaintance. In the first information, it is alleged that accused No.1 had approached the first informant with a request to provide some donation to the Trust which he was managing. The first informant appears to have represented to him that a Company was in search of a Trust for donating money and it is in this regard, the first informant had summoned accused no.1 and his friends for the purpose of meeting the representatives of the Company, which allegedly intended to donate money to the Trust of accused no.1. On the said date, the representatives of the Company had not arrived and the first informant and others along had given evasive replies. It appears that in this background the alleged victims in the present case, who were along with the first informant were kidnapped by the accused persons and subsequently a demand was made for payment of money.
During the course of investigation, the petitioner herein aged about 21 years was arrested and remanded to judicial custody on 12.06.2026. It is not in dispute that the petitioner has no other criminal antecedents. Accused No.1 and the other accused persons who had arrived to meet the first informant and the alleged victims are already arrested in the present case and remanded to judicial custody. Accused no.3 as against whom similar allegations are made, has been granted regular bail by this Court in Crl.P.No.9103/2026 disposed of on 03.08.2026.
Considering the nature of the allegations found in the first information as well as the age of the petitioner who has no antecedents, I am of the opinion that the prayer made by the petitioner for grant of regular has to be answered in the affirmative. Accordingly, the following order:
The Petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.184/2026 registered by Attibele Police Station, Bangalore Rural District for the offence punishable under Section 137(2), 140(2) read with Section 3(5) of The Bharatiya Nyaya Sanhita, 2023, subject to the following conditions:
Petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with one surety for the likesum, to the satisfaction of the jurisdictional Court;
Petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
Petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
Petitioner shall not involve in similar offences in future;
Petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
