Accused no.8 in Crime No.70 of 2026 registered by Jayaprakashnagar Police Station, Bengaluru City, for offences punishable under Sections 115(2), 140(2), 329(4), 351(2), 352 R/w Section 3(5) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail.

Heard the learned counsel appearing for the parties.

FIR in Crime No.70 of 2026 was registered by Jayaprakash Nagar Police Station, Bengaluru City for the aforesaid offences against one Praveen and others, based on the first information dated 02.06.2026 received from Chethan V, who is the alleged victim in the present case. The petitioner was arrested in the present case on 10.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.6188 of 2026 was rejected on 03.07.2026 Therefore, he is before this Court.

Perusal of the material on record would go to show that, accused nos.6 and 7 in the present case had approached this Court under Section 483 of BNSS, 2023 in Crl.P.No.8883 of 2026. The said petition was allowed on 31.07.2026. In paragraph nos.4 and 5 of the said order, it is observed as follows:-

"4.

In the first information dated 02.06.2026 submitted by the alleged victim, he has stated that he and accused no.1 are involved in Crime No.102 of 2025 registered by Banashankari Police Station and in the said case they were arrested and sent to jail. Accused no.1 - Praveen had demanded money from the victim in the present case, who was in custody in Crime No.102 of 2025 along with the accused no.1, for the purpose of making arrangements for filing necessary application to be released on bail in Crime No.102 of 2025.

The victim allegedly had not paid any money to accused no.1. After the victim in the present case and accused no.1 were released from jail in Crime No.102 of 2025, accused no.1 along with his friends had entered into the house of first informant / victim on 01.06.2026 and had forcibly taken him along with them and thereafter, assaulted him demanding money. Subsequently, they had released the victim and thereafter he had approached the police".

It is not in dispute that the petitioner's name is not mentioned in the FIR and he has no other criminal antecedents. Major portion of the investigation of the case is already completed. Under the circumstances, the following:-

ORDER

(i)

Criminal petition is allowed.

(ii)

The petitioner is directed to be enlarged on bail in Crime No.70 of 2026 registered by Jayaprakashnagar Police Station, Bengaluru City, for offences punishable under Sections 115(2), 140(2), 329(4), 351(2), 352 R/w Section 3(5) of BNS, 2023, subject to the following conditions:

a)

Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b)

The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;

c)

The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d)

The petitioner shall not involve in similar offences in future;
