Judgment
Mr. Abhay Dev Sharma, Advocate for Petitioner states that he has since filed his Rejoinder Affidavit in the Registry. He further states that since the cost amount has not been paid, therefore, the Registry has placed Rejoinder Affidavit under objection. He prays for recall of this court's orders Dated 26.04.2024 to the extent it imposed cost of Rs. 5000 in case the Rejoinder Affidavit was not filed within two weeks time.
Learned Counsel for Respondent states that she received an advance copy of Rejoinder Affidavit from Petitioner on 26.04.2024. The said affidavit was filed in Registry on 16.05.2024. Learned Counsel states that it could not be filed by the given time because of unforeseen reasons. In view of the submissions of the parties and of the fact that there was slight delay in filing of the Rejoinder Affidavit in the Registry where advance copy was supplied to the opposite side within the given time, the order Dated 26.04.2024 passed by this court is recalled to the extent it imposed cost upon Petitioner for delay in filing of the Rejoinder Affidavit.
Mr. Abhay Dev Sharma, Learned Counsel for Petitioner states that he is ready with his Draft Issues. However, Learned Counsel for Respondent seeks adjournment.
