Sabyasachi Bhattacharyya, J.:-

1.

Affidavit-of-service filed in court today be kept on record.

2.

Despite service, none appears for the respondents.

3.

Learned counsel appearing for the writ petitioner submits that the writ petitioner is similarly placed as the petitioners in WPLRT 138 of 2026, which was disposed of by this court by a judgment dated August 10, 2026.

4.

By the said judgment, the self-same impugned order which is assailed in the present writ petition was set aside and the matter was remanded to the Tribunal with a direction to the private respondent to implead the writ petitioners therein as parties to the Original Application.

5.

Upon such impleadment, notice was also directed to be served on the writ petitioners and an opportunity of hearing to be given to both sides and thereafter to decide the Original Application bearing O.A. 2560 of 2025 (LRTT) afresh on merits.

6.

We find from the judgment dated August 10, 2026 passed in WPLRT 138 of 2026 that the present writ petitioner stands on similar footing as the petitioners therein and have several issues to raise in respect of the subject-matter of O.A. 2560 of 2025 (LRTT).

7.

Since we have already directed the said original application to be heard afresh on merits, there is no reason as to why similar opportunity as that given to the writ petitioners in WPLRT 138 of 2026 should be denied to the present petitioner.

8.

Accordingly, WPLRT 156 of 2026 is disposed of in the light of the observations made in the judgment dated August 10, 2026 passed in WPLRT 138 of 2026 and directing the private respondent to implead the present writ petitioner as a party to the said Original Application, bearing O.A. 2560 of 2025 (LRTT).

9.

Upon such impleadment and notice being served on the present writ petitioner, an opportunity of hearing shall be given to the writ petitioner as well as the other parties to the said Original Application.

10.

Thereafter, the learned Tribunal shall proceed to decide O.A. 2560 of 2025 (LRTT) afresh on its merits.

11.

There will be no order as to costs.

12.

Urgent certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
