By way of present petition the petitioner, inter alia, assails office order No. MeECL/LC/193/2010/14, dated 20th April, 2014 (Annexure-XVI).

The petitioner also seeks direction to the respondents to promote the petitioner to the cadre of Executive Engineer.

Mr. M. Chanda, learned counsel for the petitioner submits that the respondents No. 1 and 2 have restored the seniority of the petitioner vide

order dated 13th April, 2017. He also submits that an affidavit of the petitioner in this regard was filed on 22nd May, 2017.

Learned counsel for the petitioner further submits that he may be permitted to withdraw the present petition with the liberty to file a

representation for grant of consequential benefits including promotion to the petitioner to the cadre of Executive Engineer. Learned counsel for the

petitioner further submits that he will file a representation within 1(one) week from today.

Learned counsel for respondents No. 1 and 2 and counsel for other respondents have no objection to the prayer made by counsel for the

petitioner. Mr. P.N. Nongbri, learned counsel for respondents No. 1 and 2 submits that the respondents will decide representation of the petitioner

within a period of 3(three) weeks.

Having considered the facts and circumstances of the case and submissions made by learned counsel for both the parties, the present petition is

dismissed as withdrawn. However, the petitioner is at liberty to file a representation to the respondents No. 1 and 2 for grant of consequential

benefits including promotion to the petitioner and the respondents No. 1 and 2 will decide the same within a period of 3(three) weeks from the

date of filing of representation, in accordance with law.

With the aforesaid observations, writ petition stands disposed of.
