The petitioner is seeking a writ in the nature of certiorari for quashing the impugned order dated 31.12.2021 (Annexure P2) whereby respondent No. 3 has been promoted as Chief Engineer out of turn superseding the petitioner in utter violation of the seniority list dated 10.11.2020 (Annexure P1).
Learned senior counsel appearing for the petitioner contends that the petitioner is senior to respondent No. 3, who has been promoted as Chief Engineer out of turn superseding the petitioner in utter violation of the seniority list dated 10.11.2020 (Annexure P1). She also contends that the petitioner has sent a representation (Annexure P4) in this regard to respondent No. 1 on 12.04.2022, but no action has been taken thereon. She further contends that the petitioner is retiring on 30.06.2022 and, therefore, respondent No. 1 may be directed to consider and decide the representation (Annexure P4) within a time bound manner.
Issue notice to the respondents.
At the asking of the court, Mr. R.L. Sharma, Advocate, accepts notice on behalf of respondents No. 1 and 2.
Heard. Without expressing anything on the merits of the case, the petition is disposed of with a direction to respondent No. 1 to consider and decide the representation (Annexure P4), in accordance with law, within a period of 15 days from the date of receipt of certified copy of this order.
