Affidavit of service is on record.

This is a Section 11 application. It arises out of an agreement dated 26th

February, 2009, which contains an arbitration clause, Clause 44. Learned counsel for

the parties agree that there are disputes between them which are referable to

arbitration.

In those circumstances, I appoint Ms. Lopita Banerjee, Advocate of this

Hon''ble High Court, at a consolidated remuneration of Rs.50,000/-, to be borne by the

parties in equal share.

The learned Arbitrator will appoint a clerk and a stenographer whose

remuneration and the other costs and charges of the arbitration will be borne by the

parties in equal share.

The learned Arbitrator will adjudicate the disputes along with any other

dispute that may arise between the parties from the statement of claim, counter-

statement and counter-claim, if any, to be filed as per the direction of the learned

Arbitrator.

6.

I most humbly request the learned Arbitrator to enter upon the reference

as soon as possible and make and publish the award within 12 months from the date of

entering upon the reference.

This application is disposed of.
