Judgment
On 25th January, 2017, this Court appointed Mr. Justice Subrata Mitra (Retired Chief Judge of the City Civil Court) as the sole Arbitrator. By the letter dated 28th February, 2017, he declined to act as an Arbitrator by citing reasons.
In those circumstances, I appoint Ms. Anwari Quraishi, Advocate of this Hon'ble High Court, in his place and stead at a consolidated remuneration of Rs.30,000/-, to be borne by the parties in equal share.
The learned Arbitrator will appoint a clerk and a stenographer whose remuneration and the other costs and charges of the arbitration will be borne by the parties in equal share.
The learned Arbitrator will adjudicate the disputes as mentioned in this Section 11 application along with any other dispute that may arise between the parties from the statement of claim, counter-statement and counter claim, if any, to be filed as per the direction of the learned Arbitrator.
I most humbly request the learned Arbitrator to enter upon the reference as soon as possible and make and publish the award within 12 months from the date of entering upon the reference.
