This is an application filed by the Debenture holders under Section 12A read with Regulations, 30A for withdrawal of the CIRP regulation through withdrawing the CP before constitution of COC. It has been brought to our notice that another application filed by the Debenture Trustee is pending before Court Room No. V of this Tribunal in CP 860/2020 which was disposed of with liberty to revive the same as this CP is already admitted.
The IA evidencing separate application on their all the five financial creditors. In the above circumstances we heard the IRP and the Counsel for the CD. Having considered the matter we allowed the application to be withdrawn. IA 4584 is allowed and disposed of.
CP 1306/2022 is disposed of. While disposing the CP all Interlocutory applications if any, stands disposed of.
