Government Pleader is directed to take notice for respondent Not. 1 to 3. The petitioner has sought for writ of mandamus, directing respondent Nos. 2 and 3, to consider the application filed by him as per Annexure C dated 29.06.1981 for registering him as an occupant of the schedule property.
According to the petitioner, petitioner''s father was the Archak of the temple namely, Sri Nagareshweraswamy Temple at Begur, which is more than 900 years old. As an Archak, his father was cultivating the property in Sy. No. 12 measuring about 25 acres 23 guntas and Sy. No. 17 measuring about 5 acres 4 guntas situated in Chandrashekarapura village of Begur Hobli, Bangalore South Taluk On the death of his father, petitioner continued to be in possession, cultivation and is also performing the Archakship. His father died on 18.1.1961. Even the RTCs produced depict the name of the father of the petitioner. Though the application is filed on 29.6.81 seeking for grant so far the respondents have not taken any steps to consider the application.
On perusal of the RTC at Annexure A which is in the name of B.N. Shankaranarayana Deekshit for the year 2011-2012, the name of Sri Nageshwara Devaru is mentioned in column Nos. 9 and 12.
It is for the Land Tribunal to consider the application of the petitioner if not already considered, in accordance with law within six months from the date of receipt of certified copy of this order and pass appropriate orders. Petition is disposed of accordingly. Government Pleader to file memo of appearance in four weeks.
