Shri Shashidhar S. Karamadi is directed to take notice for the respondents 1 to 3.

Even though the matter is listed for preliminary hearing, with consent is taken up for final disposal.

The land in question is 1 acre 32 guntas in sy.no. 73. It is not in dispute that the schedule property comes within the (Religious and Charitable) Inams Abolition Act. It belongs to Kaliyamma temple at Devarahalli. It appears that the petitioner''s father had made an application to the Deputy Commissioner for confirmation of the rights. It is also submitted that another one Bootharangappa had also made an application but however, the said application is considered by the Land Tribunal way back in the year 1981. Annexure-H, a circular has been issued by the Deputy Commissioner asking for certain information.

Be that as it may. If the petitioner has made an application for confirmation of occupancy rights under the (Religious and Charitable) Inam Abolition Act, the Deputy Commissioner who has the jurisdiction to deal with the matter, to consider the same, if not already considered in accordance with law. With this observation, the petition stands disposed of.

Shri Shashidhar S. Karamadi, High Court Government Pleader is permitted to file his memo of appearance within a period of four weeks.
