Judgment
This petition is filed seeking the following prayers:
“i)Issue a Writ of mandamus directing the respondent No.2 and 4 to consider the representations dated 12.09.2024, 28.01.2024, 17.07.2025 and 28.07.2025 vide Annexure-A to D.
ii) Issue writ of mandamus directing the respondent No.2 and 4 to reinstate the petitioner and pay the arrears of salary.
iii) Issue any other orders or directions in the circumstances as it deems fit to this Hon’ble court in the interest of justice and equity.”
Heard Sri.Rahul P., learned counsel appearing for the petitioner, learned Additional Government Advocate appearing for respondent Nos.1 and 2 and meticulously perused the material available on record.
Despite service of notice, there is no representation for respondent Nos.3 and 4.
The petitioner was appointed as an Engineer by respondent No.4, on a monthly salary of Rs.15,000/-, pursuant to the appointment order dated 08.11.2021, produced at Annexure-E. It is averred that the petitioner continued to work with respondent No.4. However, in the year 2024 his services were discontinued without any reasons or enquiry. Aggrieved by the same, the petitioner submitted representations to respondent No.4 dated 12.09.2024, 28.01.2025, 17.07.2025 and 28.07.2025, produced at Annexures-A to D respectively, wherein the petitioner is seeking continuation of his services. However, the said representations have not been considered.
The aforesaid representations have been submitted to respondent No.4, who is required to consider the same in accordance with law. Without expressing any opinion on the merits of the case, I am of the considered view that it would be appropriate to direct respondent No.4 to consider the petitioner's representations referred supra and take an appropriate decision in accordance with law. Accordingly, I proceed to pass the following:
ORDER
The writ petition is allowed.
A writ of mandamus is issued to respondent No.4 to consider the petitioner’s representations dated 12.09.2024, 28.01.2025, 17.07.2025 and 28.07.2025, produced at Annexures-A to D respectively and take an appropriate decision in accordance with law, within a period of four months from the date of receipt of a copy of this order.
No order as to costs.
