Judgment
ORDER
03.03.2022: Heard Learned Counsel for the Appellant and Learned Counsel appearing for the Resolution Professional. With the consent of the parties, the Appeal is finally disposed of at the admission stage.
This Appeal has been filed by the members of the Committee of Creditors (CoC) challenging the order dated 16.11.2021 passed by the Adjudicating Authority (National Company Law Tribunal), New Delhi, Court-III, by which order the matter was adjourned for 10.12.2021. We are of the view that against such kind of order, no Appeal can be entertained.
Learned Counsel for the Appellant submits that this Tribunal has earlier on 23.03.2021 has already passed an order requesting the Adjudicating Authority to hear the matter according priority and to make earnest efforts for early disposal of the matter as it pertains to the year 2018. It is submitted that in spite of the order dated 23.03.2021, I.A. 576/2019 which was filed for approval of the Resolution Plan has not yet been disposed of.
Learned Counsel for the Resolution Professional submits that there are other Applications which need to be considered while disposing of the Application.
In view of the fact that the matter pertains to the year 2018 and this Tribunal has already requested the Adjudicating Authority on 23.03.2021 to dispose of the Application giving priority but the same is still pending. We again request the Adjudicating Authority to dispose of I.A 576 of 2019 as well as other pending Applications at an early date.
Learned Counsel for the Appellant submits that the next date fixed on 26.03.2022. The Adjudicating Authority shall endeavor to dispose of the Application on the next date or as early as possible preferably within a period of three months from today.
The appeal is disposed off accordingly.
