The applicant was an Additional Secretary in Finance Department, Government Secretariat, State of Keralam. The applicant claims that despite her superannuation on 31.12.2025, she is eligible and qualified for selection and appointment in Indian Administrative Service (IAS) from the Non-SCS Quota for the year 2025. Annexure A1 is the notification dated 10.09.2026 issued by the GAD Department, Government of Keralam inviting nominations of the eligible candidates to the said post. The applicant is stated to be one among Non-SCS officers who is proposed to be considered for promotion in terms of IAS (Appointment by Selection) Regulations, 1997, evidenced by Annexure A5.

The applicant has approached this Tribunal on an apprehension that in the light of her superannuation on 31.12.2025, the application proposed to be submitted by her is likely to be rejected on that ground alone.

Mr. M.N. Manmadan, learned SCGSC took notice for Respondent No.1 and Mr. M.M. Salim, learned Sr. GP took notice for Respondent No.2 and Mr. Thomas Mathew Nellimoottil, learned Nodal Counsel took notice for Respondent Nos. 3 and 4.

Having heard the learned Counsel for the applicant, the learned Nodal Counsel, the learned SCGSC and also the learned Sr. GP, we are inclined to dispose of the Original Application itself at the threshold, with a direction that if the applicant submits an appliation and she is found to be otherwise eligible, she may be considered along with other eligible candidates on merits, notwithstanding her superannuation on 31.12.2025.

The O.A is disposed of as above. No costs. Hand over copy of the order.
