Judgment
On mentioning, the matter is taken on Board. Mr. P. S. Thakre, Practicing Company Secretary is present and submitted that he is making this representation on behalf of the Ms. Tanuja Jalan, who was appointed as IRP of Varron Aluminiumm Pvt. Ltd. by an order passed by Court No. III of NCLT, Mumbai Bench in C.P No. 99/2019. It is submitted that the Court No. III had admitted the CIRP petition in C.P No. 99/2019 on 15.10.2019 and the order was delivered on 06.11.2019.
Subsequent to the above admission order, this Bench has admitted the CIRP petition against this Corporate Debtor in C.P. No. 3281/2018 by an order dated 27.11.2019, who happens to be the Corporate Debtor in this petition also. In view of the fact that already there is a CIRP order against the same Corporate Debtor and the second CIRP order cannot be passed against this Corporate Debtor, the order passed by us on 27.11.2019 in this C.P. is withdrawn and the petitioner is directed to approach the IRP in C.P. No. 99/2019. The professional representing the IRP is directed to intimate this order to the petitioner in C.P. 3281/2018 and also the IRP appointed in this petition.
Accordingly, the C.P. 3281/2018 is closed.
