ORDER
MA 250/2020 In C.P. (IB) 2053/(MB)/2018
This is an application filed by the Applicant CoC U/s 12A of the Code for withdrawal of the CIRP petition.
Counsel for the applicant submits that a CIRP Order (CP (IB) 2120/2019) was passed against the Corporate Debtor (Global Sourcing & Procurement Consolidation Ltd) on 22.10.2019 by Court IV, NCLT, Mumbai Bench.
However, this court has also passed another CIRP Order against the same Corporate Debtor on 13.11.2019.
In view of the above said two orders, the subsequent order passed on 13.11.2019 by us is recalled as the same is non est in law and accordingly, this application is allowed, CP. (IB) 2053/2018 is closed.
The Petitioner in CP (IB) 2053/2018 is at liberty to file its claim before the IRP appointed in CP (IB)2120/MB/2019.
