Judgment
The prayer in the application is for a permanent injunction against the official respondents from illegally dumping Municipal Solid Waste in Survey Nos.7, 8 and 19 of Vengaivasal Village, Vengaivasal Pancyayat, Tambaram Taluk, Kancheepuram District.
It is admitted that as on date there is no dumping of Municipal Solid Waste in Survey Nos.7, 8 and 19 of Vengaivasal Village. The Block Development Officer, who is also the Special Officer of the 1st respondent Panchayat has submitted that at present they are dumping in another Tharisu land comprised in Survey No.240/4 in an extent of 0.7.10 ha. He has also submitted that in November, 2016 an application has been filed for "authorisation" to the Tamil Nadu Pollution Control Board (Board).
If such application is received, the Board shall process the same and pass appropriate orders expeditiously in any event, within ten days from the date of receipt of copy of this order. We make it clear that the 1st respondent - Panchayat shall not dump Municipal Solid Waste in Survey Nos.7, 8 and 19 of Vengaivasal Village at any point of time.
With the above direction, the application stands closed.
