These are applications by the respective petitioners for dispensing with filing of impugned order as the same has been filed in BLAPL No. 5958 of 2026.

Heard and perused the record. For the reasons stated therein, the prayer stands allowed and the filing of certified copy of the impugned orders by the petitioners stand dispensed with. Accordingly, the aforesaid three I.As stand disposed of.

Since these four regular bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsels for the parties.

These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Daspalla P.S. Case No. 120 of 2026 arising out of G.R. Case No. 228 of 2026 pending in the Court of learned JMFC, Daspalla, for commission of offence punishable U/Ss.303(2)/3(5) of BNS r/w. Section 51 of Orissa Mine and Minerals (Concession Rules) and Section 3 & 5 of the Explosive Substance Act, on the allegation of illegal mining by blasting stones with explosive substances.

Heard, Mr. Soura Chandra Mohapatra, learned Senior Counsel appearing along with Mr. S. Mohapatra, learned counsel for the petitioners by filing appearance memos which are taken on record; and Mr. T.K. Acharya, learned Addl. PP in the matter and perused the record.

After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-‡-vis the accusations sought to be brought against them and regard being had to the pre-trial detention of the petitioners in custody since 18.05.2026 and the main allegation of illegal mining being directed against co-accused M/s. Durga Condev and its Director, but the petitioners being the employee of such firm and keeping in view the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial and the offences alleged against the petitioners being not punishable beyond ten years, this Court without expressing any view on merit, admits each of the petitioners to bail.

Hence, these four bail applications of the petitioners namely Soumya Ranjan Sahoo (BLAPL No. 5958 of 2026); Benudhar Behera (BLAPL No. 5959 of 2026); Arabinda Nayak (BLAPL No. 5960 of 2026) and Suryamani Sahoo (BLAPL No. 5994 of 2026) stand allowed and each of the petitioners are allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) each with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.

Accordingly, these BLAPLs stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
