Since these four bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Khordha Model PS Case No.284 of 2026 corresponding to GR Case No.632 of 2026 pending in the file of learned SDJM, Khordha, for commission of offences punishable U/Ss.304/317(4)/ 3(5) of BNS, on the main allegation of snatching away the gold chain from the neck of the wife of the informant and receiving stolen property.
Heard, Mr. Susampad Hota, learned counsel for the petitioner in BLAPL No.6474 of 2026; Mr. Rohit Ranjan Ray, learned counsel appearing virtually for the petitioner in BLAPL No.6429 of 2026; Mr. Asit Kumar Jena, learned counsel for the petitioner in BLAPL No.6686 of 2026; Mr. Suraj Mohanty, learned counsel for the petitioner in BLAPL No.6729 of 2026 and Mr. M.R. Patra, learned Additional Public Prosecutor in the matter and perused the record. On being queried about the criminal antecedent of the petitioners, learned counsels for the respective petitioners’ volunteer to withhold bail to the petitioners, if he/they is/are found to have any criminal antecedent.
After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-‡-vis the accusations sought to be brought against them and regard being had to the pre-trial detention of the petitioners in custody since 04.06.2026 with substantial progress in investigation and keeping in view the recovery of some cash from the co-accused persons and the petitioners-Niranjana Sahoo, Santosh Kumar Sahoo and Jaydev Pal being allegedly implicated for receiving the stolen property and taking into account the other circumstances on record in entirety including the inherent right of the accused-petitioners to be presumed innocent until proven guilty at the trial and there being no material to suggest that the petitioners would abscond or pose threat to the witnesses in the event of their enlargement on bail, this Court without expressing any view on merits admits each of the petitioners to bail, but subject to verification of their criminal antecedents.
Hence, these four bail applications of the petitioners namely Niranjana Sahoo (In BLAPL No.6474 of 2026); Santosh Kumar Sahoo (In BLAPL No.6429 of 2026); Raka @ Gudul Behera (In BLAPL No.6686 of 2026) and Jaydev Pal (In BLAPL No.6729 of 2026) are allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
In view of the specific submission as advanced for the petitioners, the benefit of this order shall not be extended to the concerned petitioner(s), if he/they is/are found to have any criminal antecedent.
Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
