In compliance of the order passed in the writ petition, a show cause has been filed by the opposite party no. 2. The Batane Reservoir Scheme Co-ordination Committee considered the case of the petitioner and decided to treat him as a displaced person vide Minutes dated 10th October, 2017. Thereafter, petitioner was asked to appear through letter dated 14th October, 2017 for issuance of Vikash Pustika. Vikash Pustika has been issued in favour of the petitioner along with admissible monetary benefits under the Rehabilitation Policy to the tune of Rs. 4,57,000/- as per letter dated 20th November, 2017.

Learned counsel for the opposite parties submits that the order has been complied with and after further inquiry, payments claimed by the petitioner under the Heads of Land and Training Subsidy would be paid.

Learned counsel for the petitioner submits that the opposite parties have failed to provide full benefits under the Rehabilitation Policy. The amount in question has been remitted to the Account of the petitioner without his consent. He has also made submission about the merits of the claim admitted by the opposite parties.

However, upon consideration of the show cause and the submission of learned counsel for the parties, this Court is of the clear view that the order passed in the writ petition contemplated the respondents to take an early decision in the matter of claim of the petitioner as a displaced person under Revised Rehabilitation Policy, 2003 and dependent upon the said decision to accord benefits within a reasonable time. Therefore, this Court is of the view that the order has been complied with. Petitioner, if has remaining grievances, is at liberty to approach the concerned respondent or raise the cause of action in a fresh proceeding.

Accordingly, the instant petition stands disposed of.
