The present writ petition has been filed under Article 226/227 of the Constitution of India for issuance of an appropriate writ or order in the nature of mandamus directing respondents to verify petitioner’s Backward Class Block B Non-Creamy Layer certificate dated 15.04.2026 (Annexure P-8) and thereafter to consider the petitioner for appointment to the post of Post Graduate Teacher (PGT) English under BC Block B Non-Creamy Layer category in accordance with merit and the applicable recruitment rules. Further praying for issuance of a writ in the nature of certiorari for quashing the final result dated 11.05.2026 (Annexure P-10) to the limited extent it has excluded the petitioner from consider under BC Block B Non-creamy layer category without verification of her certificate.

Learned counsel for the petitioner, at the very outset, submits that he would be satisfied if the present writ petition is disposed of with a direction to respondents/competent authority to consider and decide the legal notice dated 30.07.2026 (Annexure P-13), by passing a reasoned and speaking order, strictly in accordance with law, within a time-bound period.

On advance notice, learned State counsel as well as learned counsel for respondent-Haryana Public Service Commission, accepts notice on behalf of the respective respondents and submit that they have no objection in case a direction is issued to respondents/competent authority to consider and decide the legal notice dated 30.07.2026 (Annexure P-13), by passing a reasoned and speaking order, strictly in accordance with law, within a stipulated period. However, learned counsel for the respondent-Commission submits that the petitioner has not placed the correct facts before this Court. It is contended that the petitioner participated in the selection process pursuant to Advertisement No.23/2026 dated 05.02.2026, wherein it was specifically stipulated that the candidates were required to upload the latest income certificate in terms of the instructions issued by the Government of Haryana. Since the petitioner failed to upload the requisite latest income certificate along with the application form, her candidature was not liable to be considered.

In view of the limited prayer made by learned counsel for the petitioner and without expressing any opinion on the merits of the claim, the present writ petition is disposed of with a direction to respondents/ competent authority to consider and decide upon the legal notice dated 30.07.2026 (Annexure P-13) by passing a reasoned and speaking order strictly in accordance with law, within a period of three months from the date of receipt of a certified copy of this order. The decision so taken shall be communicated to the petitioner forthwith.

It is needless to observe that, in the event the petitioner is found entitled to the relief claimed, the same shall also be extended expeditiously, strictly in accordance with law.

Pending miscellaneous application(s), if any, shall also stand disposed of.
