Bhaskar Raj Pradhan, J
Vide Order dated 17.09.2025 the matter was referred for Mediation when, the appellant as well as respondent nos. 1 and 2 represented by the learned counsel and the respondent no.3 appeared in person.
On the said date the respondent no.3 who appeared in person made a statement that as he could not afford a private lawyer so he has applied to the Sikkim State Legal Services Authority (SSLSA) but due to the unavailability of his caste certificate it is yet to be processed. This statement was recorded in the order dated 17.09.2025.
Pursuant thereto a communication has been received from the SSLSA dated 23.09.2025 informing that the respondent no.3 had in fact, not applied for legal aid. It transpires that thereafter, the Registry listed the matter today. As the rest of the parties were represented by their respective counsel they were duly informed and they are present today. However, the respondent no.3 is not present as no information was communicated to the respondent no.3.
List this matter again on 03.11.2025 before which date the respondent no.3 shall also be communicated to appear before this Court.
