The instant writ application has been preferred by the petitioner for the following reliefs:

“1.

i. To give the direction to the competent authorities to consider the out of turn promotion under rule 660(C) of Police Manual on the post of Assistant Sub Inspector, as the similarly situated person namely Sanjay Kumar Yadav (Constable No.-671) has been awarded for Gallantry award and promoted on the post of Assistant Sub Inspector by the Respondents.

AND/OR

Pass such other order / orders, writ /writs, direction/directions upon the respondents as Your Lordships may deem fit and proper in the facts and circumstances of this case.”

Learned counsel for the petitioner submits that the petitioner has been awarded Gallantry award and he fulfills all criteria which were required on the part of the petitioner, even though the respondents have not taken any interest towards the out of turn promotion under Rule 660(C) of the Police Manual nor his name was recommended by the competent authorities for any medal or award. He submits that this writ application may be disposed of with liberty to the petitioner to approach the concerned respondent for redressal of his grievance in the light of Annexure-2 and 3 to the writ applicaiton.

Learned counsel for the respondents submits that since no counter affidavit has been filed, as such the petitioner may approach the concerned respondent for redressal of his grievance.

Having regard to the aforesaid, the instant writ application is hereby disposed of by directing the 2nd Respondent to treat this writ application as representation and taking assistance with other respondents, the claim raised in the writ application by the petitioner shall be considered in accordance with law and applicable rules and regulations by passing a reasoned and speaking order.

The entire exercise shall be completed within a period of 12 weeks from the date of receipt/production of copy of this order. The petitioner is also directed to serve a copy of this writ application to the 2nd Respondent at the earliest so that his grievance can be redressed.

Pending I.A, if any, also stands disposed of.
