Judgment
This habeas corpus petition has been filed by the petitioner alleging that he has solemnized marriage with the daughter of respondent No.5 on 16.08.2021 and thereafter they went to Shimla and stayed there in a hotel where, the respondent Nos.5 and 6 came and forcibly took his wife. It is alleged that now the wife of the petitioner is in illegal confinement of respondent Nos.5 and 6.
Having heard learned counsel for the petitioner and after going through the averments made in this habeas corpus petition, we deem it appropriate to issue notices to the respondent Nos.1 to 4, subject to the condition that the petitioner shall deposit peremptory costs to the tune of Rs.1,00,000/- with the Registrar (Judicial), Rajasthan High Court, Bench Jaipur within two days from today.
Learned Public Prosecutor is directed to accept notice on behalf of respondent Nos.1 to 4 and is also directed to submit a factual report by the next date of hearing.
In case, the peremptory costs is not deposited by the petitioner within two days from today, the matter be listed before this Court for further orders and if the peremptory costs is deposited within the stipulated time, the matter be listed on 20.09.2021 and on that date, learned Public Prosecutor shall furnish the latest factual report.
