This bail application has been filed under Section 439 Cr.P.C in connection with FIR No.465/2020 registered at Police Station Shivdaspura, Jaipur

District for the offences under sections 365, 366, 376, 323, 341, 366 and 376 (2) (N) IPC and section 67a of the IT Act.

Learned counsel for the petitioner submits that petitioner was arrested on 23.11.2020. Petitioner and prosecutirx got married on 19.3.2020 against the

will and consent of their family members and thereafter, they were living together as husband and wife for about two months. After two months,

father of the prosecutirx came to the house of the petitioner and prosecutrix went with her father's home to meet her family members. After that, FIR

has been lodged after a delay of seven months. It is further submitted that a Habeas Corpus Petition has been filed by the petitioner before the

Hon'ble Allahabad High Court which is still pending. Petitioner is behind the bars since long and the conclusion of the trial will take time, hence, the

petitioner may be released on bail.

Learned Public Prosecutor has opposed the bail application. Considering the submissions made by learned counsel for the petitioner and the facts and

circumstances of the case but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to enlarge the

petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Ajay Singh S/o Gulab Singh shall be

enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/-( out of which one surety shall be

resident of Jaipur Metropolitan/ Jaipur District) each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all

the dates of hearing and as and when called upon to do so.
