Judgment
Heard learned counsel for the appellants and learned counsel for the State on the interlocutory applications filed by the appellants in both of the appeals for granting bail during the pendency of these appeals.
The appellants have been convicted and sentenced for the offences under Sections 304-B, 201 / 34 of the Indian Penal Code.
The appellants are the husband and the in-laws of the deceased, and though there is allegation against the appellants, but the impugned Judgment shows that the dead body of the deceased was found in a well in a different village and the cause of death was found to be drowning.
In the facts and circumstances of the case, we are inclined to release the appellants on bail. Accordingly, the appellants Kanchan Devi, Tukni Devi, Janki Pandit, Dinesh Pandit @ Dinesh Kumar Pandit and Ajay Pandit are directed to be released on bail during the pendency of the appeals, on furnishing bail bonds of Rs.10,000/- (Ten thousand ) each with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-1, Koderma, in connection with S.T. No. 66 of 2011.
The aforesaid interlocutory applications stand allowed.
