Judgment
Heard the learned counsel appearing for the petitioner/accused and the learned High Court Government Pleader appearing for the respondent.
The respondent-police have registered a case against the petitioner in their Cr.No.410/2016 in respect of the offence punishable under sections 406 and 420 of IPC.
The allegation is, the petitioner who runs a Fair Price Shop is having permit to distribute food coupons to the ration card holders. By hacking the password of the service centre, he fabricated 567 bogus coupons and misappropriated the ration items, thus cheated the Government.
Learned counsel for the petitioner submits that the petitioner is not aware of the technical aspects and he has not committed the offence as alleged.
Having regard to the nature of allegation, there is no impediment to allow the petition.
Accordingly, the petition is allowed. Petitioner is granted anticipatory bail in Cr.No.410/2016 of respondent- police, subject to the following conditions:
He shall forthwith appear before the respondent-I.O. In that event, the I.O. is at liberty to interrogate him. In the event of his arrest, he shall be released on bail on executing a self bond for Rs.50,000/- with one surety for the likesum. He shall co-operate with the I.O. during further course of investigation and shall not indulge in activities as alleged in the complaint.
