Judgment
Heard Sri.N.Kumar, learned counsel for petitioner and Sri.K.Nageshwarappa, learned HCGP for respondent.
The respondent-police registered a case in Crime No.387/2016 against the petitioner (and others) in respect of the offence punishable under Sections 419, 420, 465, 408, 188 and 34 of I.P.C and Sections 3 and 7 of Essential Commodities Act, 1955.
The allegation is that the petitioner runs a Service Centre to issue coupons for distribution of ration articles to the public. By colluding with the owners of the Fair Price Depot by using the fake undistributed ration cards and by tagging the same to the Aadhar card numbers of different persons created online coupons, misappropriated ration articles.
Learned counsel for the petitioner submits that petitioner being a service provider, his role is only to issue coupons on the basis of ration card and Aadhar card number presented before him by the customers. Except the above, he has no knowledge of the alleged offence.
Having regard to the nature of the allegation, there is no impediment to allow the petition.
Petition is hereby allowed. Petitioner is granted anticipatory bail in Crime No.387/2016 registered by respondent-police subject to following conditions:
(i) He shall forthwith appear before the respondent-
Investigating officer.
(ii) The investigating officer is at liberty to interrogate him.
(iii) In the event of his arrest by the respondent-
investigating officer, he shall be released on bail on execution of a self bond for a sum of Rs.50,000/- with one surety for the likesum.
(iv) He shall not indulge in activities as alleged against him.
