Judgment
An application has been moved by the applicant against the respondents under Section 12 of the Protection of Women from Domestic Violence
Act before the learned Magistrate, which has been registered as Criminal Complaint Case No. 01 of 2017.
Learned counsel for the applicant submits that the matter is pending before the court below since 04.01.2017. Learned counsel for the applicant
further submits that under Section 12 (5) of the Protection of Women from Domestic Violence Act, all efforts shall be made by the learned
Magistrate to dispose of the matter within a period of sixty days from the date of its first hearing but the same has not been done.
The application filed under Section 482 of CrPC stands disposed with the direction to the learned Chief Judicial Magistrate, Kashipur, District
Udham Singh Nagar to decide the matter as expeditiously as possible in letter and spirit of Section 12 (5) of the Protection of Women from
Domestic Violence Act, without granting any undue adjournments to any of the parties.
