Judgment
O R D E R
Heard the learned counsel for the applicant, learned counsel for the respondents and perused the records.
Through this Original Application, applicant has prayed for the following relief(s):
“I. To issue an order or direction commanding the respondents to finalize and decide the pending claim of the applicant for compassionate appointment strictly in accordance with applicable rules, policy and the assessment already conducted by the respondents, by passing a reasoned and speaking order within stipulated period as may be fixed by this Hon’ble Tribunal.
b. To further issue an order or direction commanding th respondents to consider the candidature of the applicant against available vacancies under compassionate appointment quota in light of assessment already conducted by the respondents.
c. To issue any other suitable order or direction which this Hon’ble Tribunal may deem fit and proper under the facts and circumstances of the case.
d. To award cost of the Original Application in favour of the applicant.”
Learned counsel for the applicant submitted that the instant O.A. may be disposed of as applicant is only seeking decision on the representation preferred by her and ends of justice would be served if a direction is given by this Tribunal to the respondents/competent authority to consider and dispose of the pending representation of the applicant attached as Annexure No. 3 [page 24-25] to this O.A. in the light of letter dated 23.06.2023 issued by Ministry of Road Transport & Highways (Establishment I Section) attached as Annexure No. 7 (page 29-30 of the paper-book) by way of reasoned and speaking order within a stipulated period of time.
Learned counsel for the respondents orally opposed, however, submitted that in case the applicant’s representations are directed to be decided in the manner suggested then sufficient time may be allowed for the same.
In view of the above submission, respondents / competent authority are directed to consider and decide the representation of the applicant attached as Annexure No. 3 [page 24-25] to this O.A. in the light of letter dated 23.06.2023 issued by Ministry of Road Transport & Highways (Establishment I Section) attached as Annexure No. 7 (page 29-30 of the paper-book) and pass a reasoned and speaking order as per law within a period of two months from the date of receipt of certified copy of this order under intimation to the applicant forthwith.
Merits of the case has not been touched upon by the Tribunal.
The OA is disposed of accordingly.
There is no order as to costs.
