Judgment
Nobody appears on behalf of the Petitioner. Heard the counsel for the State.
This writ petition has been filed for direction upon the Respondents to produce the husband of the Petitioner namely, Shankar Gouda said to be missing since July 2004 from Kumardubi Colliery of Eastern Coalfields Limited where he was working as Under Ground Loader since 25/07/1997.
From the counter affidavit it appears that on enquiry from the Eastern Coalfields Limited, it transpired that Shankar Gouda proceeded on annual leave on 02/07/2004 and was supposed to join his duty on 14/07/2004 but he did not join his duty. Accordingly, a departmental proceeding was initiated and, thereafter, he was dismissed from service. On this information a Station Diary entry was recorded in June 2011 in the concerned police station. It further appears that during enquiry some of the workmen of the Eastern Coalfields Limited namely, Anil Prasad Pandey, Subhas Swai etc. stated interalia before the OfficerinCharge, Kumardubi that Shankar Goudaa went on leave but did not come back.
Learned State counsel submitted that the Petitioner has moved this Court after about 7 years. He further submitted that there was no complaint by anybody including the Petitioner about missing of Shankar Gouda for a long period of about 7 years. He also submitted that this writ petition has been filed for oblique purposes.
The statements made in the counter affidavit have not been controverted though opportunity for filing rejoinder was given.
In the circumstances, in our opinion, no relief can be granted to the Petitioner. The Petitioner approached this Court after about 7 years from the alleged missing of her husband Shankar Gouda.
In the result, this writ petition is dismissed. However, no costs.
