The petitioner has filed the present application against the order of the Central Administrative Tribunal, Patna Bench, Patna, dated 11.1.2007, in O.A. No. 847 of 2004, whereby, her application for appointment on compassionate ground was not allowed. Hence, this petition under Article 226 of the Constitution of India. Virtually facts of the case are not in controversy.

The case of the petitioner is that her case for appointment on compassionate basis was not considered by the Circle Relaxation Committee and her name was kept in the waiting list for want of vacancy. She was asked to submit her willingness within a week to the concerned respondent authority for appointment as Gramin Dak Sewak (GDS), but she expressed inability to work on that post on 21.8.2001. Later on, by three orders she was asked to submit her willingness, if she desires to work on the post of Gramin Dak Sewak, but she again expressed her unwillingness. It is in this context, the original application before the Tribunal came to be rejected and we find no merit or substance in this writ petition under Article 226 of the Constitution of India. Therefore, the petition shall stand dismissed at the threshold after hearing both the parties at the admission stage. Rule is discharged. No cost.
